Terms & Conditions
Last updated 18 August 2026
These terms govern use of NoshUp, a QR ordering and payment platform for restaurants in South Africa, operated by K2025921632 (South Africa), registration number K2025921632, trading as NoshUp (“NoshUp”, “we”, “us”). NoshUp connects two kinds of user in one service, and different sections below apply depending on which one you are:
- Diners — anyone scanning a table’s code to browse a menu, place an order, and pay.
- Restaurants — the business (and its staff) using NoshUp to publish a menu, receive orders, and get paid.
By using NoshUp in either capacity, you agree to these terms. If you’re agreeing on behalf of a restaurant, you confirm you have the authority to do so.
1. What NoshUp is — and isn’t
NoshUp is a technology platform. We provide the menu, ordering, and payment infrastructure that connects diners and restaurants — we are not a restaurant, we don’t prepare or serve food, and we’re not a party to the sale of food itself. That contract is between the diner and the restaurant. Our role is facilitating it: showing the menu accurately as the restaurant set it, routing the order, and processing the payment.
2. Diners
2.1 No account required
You can order as a guest — NoshUp doesn’t require you to create an account, and we don’t ask for a name, phone number, or address to place an order. An email address is only ever requested optionally, if you want a copy of your receipt.
2.2 Orders and pricing
Menu items, prices, descriptions, and availability are set and maintained entirely by the restaurant, not NoshUp. We display what the restaurant has published; we don’t verify menu accuracy, ingredient information, or allergen details on their behalf. If you have a dietary requirement or allergy concern, confirm directly with the restaurant’s staff before ordering.
Placing an order through NoshUp is a request to purchase from the restaurant at the table you’re seated at. The restaurant may decline or be unable to fulfil an order (an item selling out between you viewing it and ordering, for example) — NoshUp doesn’t guarantee order acceptance or fulfilment.
2.3 Payment and tipping
Payment is processed through PayFast, a third-party licensed payment gateway. NoshUp does not receive or store your card details — they’re entered directly on PayFast’s own secure payment page. See our Privacy Policy for what we do collect.
Any tip you add is voluntary and entirely optional. 100% of the tip amount is passed to the restaurant — NoshUp takes no commission on tips, only on the order subtotal.
2.4 Refunds and order issues
Since the food and drink contract is between you and the restaurant, issues with an order — wrong items, quality, a missing item — should be raised with the restaurant’s staff directly and immediately, the same as you would with any dine-in order. For payment-specific issues (a duplicate charge, a payment that didn’t go through but was still deducted), contact us at hello@noshup.co.za and we’ll help you resolve it with the restaurant and PayFast.
3. Restaurants
3.1 Signing up
You represent that the information you provide when creating a restaurant account — business name, contact details, menu content, and banking details for payouts — is accurate and that you’re authorised to act for the business. You’re responsible for everything published under your account, including menu pricing, descriptions, availability, and any staff accounts you create.
3.2 Fees
Using NoshUp costs a subscription fee plus a commission on each order’s subtotal, as set out on our Pricing page or in your specific signup offer. Commission is charged on the order subtotal only — never on tips, and never on tax or a service charge you add. Fees may change with reasonable notice; continued use after a fee change takes effect means you accept the new fees.
3.3 Getting paid
NoshUp uses a third-party payment processor (currently PayFast) to collect diner payments and remit your share to your nominated bank account, less NoshUp’s commission. Payouts are subject to that processor’s own verification requirements and payout schedule, which we’ll communicate as part of onboarding. We’re not a bank and don’t hold your funds beyond what’s required to route a payment from a diner to you.
3.4 Your responsibilities
As the party actually selling food, you’re responsible for:
- Food safety, hygiene, and all applicable health regulations
- Accurate menu pricing, descriptions, and allergen information
- Fulfilling orders placed through NoshUp in good faith
- Your own compliance with consumer protection, tax, and labour law — including how tips are distributed to staff, which remains entirely your process
- Keeping your staff logins secure and only giving access to people you trust with them
3.5 Suspension and termination
You can stop using NoshUp at any time. We may suspend or terminate a restaurant’s account for non-payment, fraud, repeated food safety complaints, or a material breach of these terms, with notice where reasonably possible.
4. Acceptable use
Don’t use NoshUp to attempt to defraud diners or restaurants, interfere with the platform’s operation, access another restaurant’s or diner’s data without authorisation, or use the service for anything unlawful.
5. Intellectual property
NoshUp’s software, design, and branding are our property. A restaurant’s menu content, photos, and branding remain theirs — by publishing on NoshUp, a restaurant grants us a licence to display that content as part of operating the service.
6. Disclaimers and limitation of liability
NoshUp is provided “as is.” We work to keep the service reliable, but we don’t guarantee it will be uninterrupted or error-free. To the extent permitted by law, NoshUp isn’t liable for the quality, safety, or fulfilment of food and drink ordered through the platform — that responsibility sits with the restaurant. Our liability for any claim relating to the platform itself is limited to the fees you paid us (for restaurants) or, for diners, the value of the specific order in question.
7. Changes to these terms
We may update these terms from time to time. We’ll post the updated version here with a new “last updated” date; material changes affecting restaurants will be communicated directly.
8. Governing law
These terms are governed by the laws of South Africa, and any dispute not resolved informally is subject to the jurisdiction of the South African courts.
